1. Acceptance of Terms

By accessing or using HandyInvoice.biz (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

HandyInvoice provides a voice-first invoicing platform that allows tradespeople and contractors to create, send, and track invoices via phone calls, SMS, WhatsApp, and web interface. The Service includes:

  • Voice-to-invoice creation via phone calls
  • SMS and WhatsApp messaging for invoice management
  • Professional PDF invoice generation and email delivery
  • Payment tracking and processing through Stripe
  • Web dashboard for invoice and customer management
  • Tax reporting and export features

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be legally able to enter into a binding contract
  • Operate a legitimate business or trade service

You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

4. Subscription Plans and Billing

4.1 Plans

HandyInvoice offers the following subscription plans:

  • Basic: $20/month - 30 invoices included, $1.99 per additional invoice
  • Standard: $29/month - 50 invoices included, $0.99 per additional invoice
  • Premium: $39/month - 75 invoices included, $0.99 per additional invoice

4.2 Free Trial

New accounts receive a 14-day free trial with access to all features of the selected plan. Your credit card will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged the monthly subscription fee.

4.3 Billing Cycle

Subscriptions are billed monthly in advance. Your billing cycle starts on the day you subscribe and renews each month on the same day.

4.4 Overage Charges

If you exceed your plan's included invoice limit, you will be charged the overage rate for each additional invoice. Overage charges are billed at the end of your billing cycle. You will receive notifications when you reach 80%, 95%, and 100% of your limit, and you must authorize overage charges to continue creating invoices beyond your limit.

4.5 Payment Processing

All subscription payments are processed securely through Paddle. By subscribing, you authorize Paddle to charge your payment method for the subscription fee and any applicable overage charges.

4.6 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of your next billing cycle.

5. Payment Terms for Your Customers

HandyInvoice integrates with Stripe to enable your customers to pay invoices via credit card. When you connect your Stripe account:

  • You agree to Stripe's terms of service
  • Customer payments are processed directly to your Stripe account
  • Stripe's standard processing fees apply (2.9% + $0.30 per transaction)
  • You are responsible for refunding customers directly through Stripe
  • HandyInvoice is not responsible for payment disputes between you and your customers

6. Use of Communication Channels

6.1 Phone and SMS

By using the Service, you consent to receive automated phone calls and SMS messages from our system at the phone number you provide. Standard message and data rates may apply. You can opt out of SMS messages by replying STOP.

6.2 WhatsApp

If you use WhatsApp to interact with HandyInvoice, you consent to receive messages via WhatsApp Business API. You can stop receiving WhatsApp messages by blocking the number or requesting removal.

6.3 Email

You consent to receive transactional emails related to your account, invoices, and service notifications. You cannot opt out of essential service emails but may unsubscribe from marketing emails.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Send spam or unsolicited messages to customers
  • Impersonate another person or entity
  • Upload malicious code or attempt to disrupt the Service
  • Scrape, copy, or reverse engineer the Service
  • Share your account with others
  • Create fraudulent invoices or engage in deceptive practices
  • Violate any laws, regulations, or third-party rights
  • Use the Service in a way that could harm HandyInvoice or other users

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

HandyInvoice and its original content, features, and functionality are owned by HandyInvoice and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of the content you create (invoices, customer data, etc.). By using the Service, you grant us a limited license to host, display, and process your content solely to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We take data security seriously and implement industry-standard measures to protect your information.

You are responsible for:

  • Ensuring you have the right to store customer information
  • Complying with applicable data protection laws (GDPR, CCPA, etc.)
  • Obtaining consent from your customers to send them invoices
  • Maintaining accurate customer contact information

10. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency maintenance
  • Third-party service disruptions (Twilio, Stripe, Cloudflare, etc.)
  • Force majeure events

We will make reasonable efforts to notify you of planned maintenance in advance.

11. Third-Party Services

HandyInvoice integrates with third-party services including but not limited to:

  • Twilio (voice, SMS, WhatsApp)
  • Stripe (payment processing)
  • Paddle (subscription billing)
  • Clerk (authentication)
  • Deepgram (transcription)
  • Resend (email delivery)

Your use of these services through HandyInvoice is subject to their respective terms of service. We are not responsible for the availability or functionality of third-party services.

12. Cancellation and Termination

12.1 Cancellation by You

You may cancel your subscription at any time from your account dashboard or by contacting support. Upon cancellation:

  • You will not be charged for subsequent billing cycles
  • You retain access to the Service until the end of your current billing period
  • Your data will be retained for 30 days after cancellation
  • After 30 days, your account and data will be permanently deleted

12.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Service
  • Your payment method fails repeatedly
  • You engage in fraudulent or illegal activity
  • We discontinue the Service (with 30 days notice)

If we terminate your account for violation of terms, you will not receive a refund for any remaining subscription period.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDYINVOICE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Errors or inaccuracies in invoices generated by the Service
  • Payment disputes between you and your customers
  • Third-party service failures or disruptions

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS OR $100, WHICHEVER IS GREATER.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of invoice data

16. Indemnification

You agree to indemnify and hold harmless HandyInvoice, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Disputes between you and your customers

17. Dispute Resolution

17.1 Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law provisions.

17.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except for small claims court actions. You waive the right to participate in class action lawsuits.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

19. Export Compliance

You may not use the Service in violation of U.S. export laws and regulations. You represent that you are not located in a country subject to U.S. embargo or on any U.S. list of prohibited parties.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and HandyInvoice regarding the Service.
